Strategies For Preventing Inheritance Conflicts Through The Implementation of Syajarat Al-Mīrāṡ (A Case Study of the Community of Tawaroe Village, Dua Boccoe Subdistrict, Bone Regency)

This study aims to explore and analyze strategies for preventing inheritance conflicts through the implementation of the syajarat al-mīrāṡ (a case study of the Tawaroe village community in Dua Boccoe Subdistrict, Bone Regency). This study employs a qualitative field research method using a case study approach, as well as sociological and empirical theological perspectives, and utilizes observation, interviews, and documentation. The research findings indicate that the Bugis community in Tawaroe village views syajarat al-mīrāṡ as an inheritance structure or tree that illustrates family relationships and the inheritance rights of family members, which are derived from the rules of faraid. This method is considered easy to understand, consistent with Islamic teachings in the Quran (Surah Al-Nisā’/4: 11–12 and 176), and does not conflict with Bugis traditions that emphasize justice and harmony within the family. The implementation of the syajarat al-mīrāṡ in Tawaroe Village is carried out by drawing up a family tree, identifying the heirs, and calculating each person’s share in accordance with Sharia law, with the involvement of all heirs collectively. The involvement of all parties and the clarity of the inheritance structure or tree have proven effective in reducing misunderstandings and the potential for conflict.
