Justice and Partnership in Women's Dual Roles Under Islamic Family Law

Abstract

The dual role of women as homemakers and family breadwinners has become an increasingly prevalent phenomenon in modern family life. This condition raises various issues concerning the distribution of the rights and obligations of husbands and wives from the perspective of Islamic Law. This study aims to analyze the legal position of women's dual roles under Islamic Law and their relevance in promoting justice and harmony within the family. The research employs a normative legal method using conceptual and statutory approaches, supported by a literature review of the Qur'an, Hadith, the Compilation of Islamic Law, relevant legislation, and scholarly literature. The findings indicate that Islamic Law does not prohibit women from participating in the public sphere, provided that they adhere to Islamic principles, do not neglect their family responsibilities, and carry out such roles based on mutual agreement between husband and wife. Women's dual roles are regarded as a form of cooperation in fulfilling the family's needs without diminishing the husband's primary obligation as the principal provider. Therefore, justice and family harmony can be achieved through a proportional distribution of roles, effective communication, and the implementation of the principles of maqāṣid al-sharī'ah.
